White Rabbit Club RELEASE OF LIABILITY I, and as parent or legal guardian of the child (or children) whose name is set forth below (each referred to as a “Participant” and collectively referred to herein as the “Participants”) and in consideration of the Participants being permitted to participate in the Activities (as defined below) conducted by White Rabbit Club LTD, located at 1108 W Northwest Hwy, Palatine,IL 60067(“White Rabbit Club”) agree as follows: ACTIVITIES. Activities shall be defined as the various activities and services offered to Participants by White Rabbit Club, an indoor playground and cafe. AGREEMENT TO FOLLOW DIRECTIONS. Participants agree to observe and obey all posted rules and warnings, and further agree to follow any verbal instructions and directions given by White Rabbit Club LTD, or the employees of White Rabbit Club LTD. In lieu of absent verbal and written rules, warnings and objections, Participants shall act with due regard to other Participants, employees, and property. ASSUMPTION OF THE RISKS AND RELEASE. Participants recognize that there are certain inherent risks associated with the above-described activity and assume full responsibility for personal injury to oneself and family members and further release and discharge White Rabbit Club LTD for injury loss or damage arising out of Participants use of or presence upon the facilities of White Rabbit Club LTD whether caused by the fault of Participants, White Rabbit Club LTD or other third parties. Participants expressly agree and promise to accept and assume all risks existing in this activity. Participation in this activity is purely voluntary, and Participants elect to participate despite the risks. INDEMNIFICATION. Participants agree to indemnify, defend, and hold harmless White Rabbit Club LTD against all claims, causes of action, damages, judgments, cost, or expenses, including attorney fees and other litigation costs, which may in any way arise from Participants use of, or presence upon, the facilities of White Rabbit Club LTD. FEES. Participants agree to pay for all damages to the facilities of White Rabbit Club LTD caused by any neglectful, reckless, or willful actions by Participants. PHOTO RELEASE. Participants hereby grant White Rabbit Club LTD permission to use images or likeness in a photograph, video, or other digital media in all of its publications, including web-based publications, without payment, consent, or other consideration. By signing this document, Participants acknowledge that if Participants are injured or property is damaged during participation in Activities, Participants are expressing to a court of law to have waived any right to maintain or bring upon any lawsuit against White Rabbit LTD based on any claim from which Participants have released them herein. Participant agrees that this document is valid for all subsequent visits and participation at White Rabbit Club. Participants have had sufficient opportunity to read this entire document, have read and understood this document, and agree to be bound by its terms.
